Dream Arx — Terms of Service
(Including End User License Agreement)
Welcome to Dream Arx, a dating platform that enables users to connect either based on proximity or through real-time venue check-ins using QR codes. These Terms of Service, including the End User License Agreement set out within ("Terms"), govern your access to and use of the Dream Arx mobile application ("App") and any associated services.
Dream Arx is operated by Dream Arx LLC, a Wyoming limited liability company. References to "Dream Arx" in these Terms refer to Dream Arx LLC.
By accessing or using the App or any associated services, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
- You must be at least 18 years of age to create an account and use the App.
- By using Dream Arx, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.
2. Account Registration
- You agree to provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You may not impersonate another person, misrepresent your identity, or use the platform for fraudulent activities.
3. How Dream Arx Works
- Swipe Mechanics: Users can express interest via directional swipes indicating relationship intent (casual, serious, both).
- Matching: A match is formed when both users express compatible interest.
- Venue-Based Matching: Users can check in to physical venues using a QR code and connect with others at the same location.
4. License Grant
Subject to your compliance with these Terms, Dream Arx grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for personal, non-commercial use on a mobile device that you own or control.
5. License Restrictions
You agree not to:
- Modify, adapt, translate, reverse engineer, decompile, or disassemble the App.
- Use the App for any commercial purposes without written consent.
- Circumvent, disable, or otherwise interfere with security-related features.
- Reproduce, redistribute, sublicense, lease, or rent the App.
- Use the App to engage in unlawful, abusive, or disruptive behavior.
6. App Updates
Dream Arx may update the App from time to time. These updates may include bug fixes, performance enhancements, or new features. Continued use of the App constitutes acceptance of such updates.
7. User Conduct
You agree to use Dream Arx in accordance with the following rules:
- You will not harass, threaten, stalk, or defame any other user.
- You will not post offensive, illegal, or sexually explicit content.
- You will not spam, solicit, or promote commercial products/services.
- You will respect all local laws and regulations, including in-venue behavior.
8. Community Guidelines
Threats, impersonation, and nudity are strictly prohibited. Any violation may result in suspension or termination without notice.
9. Content Ownership and License
Users retain ownership of the content they upload. By posting or submitting content through the App, you grant Dream Arx a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for the purposes of operating, providing, and promoting the platform. You may not upload or share content that violates the rights of others, is defamatory, obscene, or abusive, or that contains malware or harmful code.
10. Venue Participation
- Venues that register with Dream Arx agree to uphold inclusivity and non-discrimination practices.
- Venues must allow purely offline approaches between total strangers on their premises, and may not use Dream Arx as a basis for restricting in-person social interaction.
- QR codes must be displayed in a visible and accessible manner.
- Dream Arx reserves the right to ban venues for non-compliance or reported misconduct.
11. Membership and Payments
Dream Arx offers tiered membership plans with distinct features and benefits. Current membership tiers, features, and pricing are presented within the App and applicable app store listing, and may vary by tier, time, and region. Subscriptions are auto-renewed unless canceled. California users will receive pre-renewal notifications in accordance with applicable laws.
12. In-App Purchases and Refund Policy
- Purchases such as Super Likes and membership upgrades are non-refundable.
- Auto-renewal billing continues unless canceled prior to the next billing cycle.
13. Reporting and Enforcement
- Users can report abuse or misconduct directly within the App.
- Dream Arx may investigate reported abuse or misconduct and may take action it deems appropriate, including account suspension or termination.
14. Third-Party Services
The App may integrate or link to third-party services, including but not limited to CometChat (for in-app messaging), mapping services, and payment processors. Dream Arx is not responsible for the content, policies, or practices of these third parties.
15. Termination
Dream Arx reserves the right to suspend or terminate your access at any time, without notice, for conduct that violates these Terms or that is harmful to other users or the platform. Upon termination, your license to use the App ends immediately, and you must stop using the App and delete all copies in your possession.
16. Intellectual Property
The App, together with all content, branding, and software associated with Dream Arx, is licensed, not sold, to you. Dream Arx and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights. You may not copy, modify, distribute, reverse engineer, or otherwise exploit any part of the App except as expressly permitted under these Terms.
17. Privacy
Use of the App is subject to Dream Arx's Privacy Policy, available at dream-arx.com, which explains how Dream Arx collects, uses, and stores your personal data.
18. Data Retention
- Dream Arx retains user data only as long as necessary for legitimate business or legal purposes.
- Account information may be retained for a period after deletion to support moderation and user safety.
19. Disclaimers
- Dream Arx provides the platform "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Dream Arx does not guarantee a match or the behavior of other users.
- Dream Arx is not responsible for offline interactions or venue-specific experiences.
20. Limitation of Liability
To the maximum extent permitted by law, in no event shall Dream Arx or its affiliates be liable for any indirect, incidental, consequential, or special damages arising from or relating to your use of, or inability to use, the App.
21. Indemnification
You agree to indemnify and hold harmless Dream Arx and its affiliates from any claims, liabilities, damages, or expenses arising from your use of the App or violation of these Terms.
22. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court where the claim qualifies, or seek injunctive relief in the state or federal courts located in the State of Wyoming to prevent unauthorized use or infringement of Dream Arx's intellectual property. Any arbitration will be conducted on an individual basis only, and not as a class, consolidated, or representative action.
23. Children’s Online Privacy Protection
Dream Arx is not intended for anyone under the age of 18. Dream Arx does not knowingly collect personal data from children.
24. Changes to These Terms
Dream Arx may revise these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
25. Language
These Terms are originally drafted in the English language. Any translated version of these Terms is provided for your convenience only. In the event of any conflict or inconsistency between the English version and a translated version, the English version shall control.
